That the agenda be amended to include the addendum, and as amended, be approved.

That the minutes of Committee of Adjustment Meeting Number 2026-02, held on Monday, January 26, 2026, be approved.

Recommendation: That consent application, File Number D10-032-2024, to sever an approximately 1.1 hectare parcel of land with approximately 125.1 metres of frontage onto Highway 38, be provisionally approved subject to the conditions included in Exhibit A (Recommended Conditions) to Report Number COA-26-013; and That consent application, File Number D10-033-2025, to sever an approximately 1.2 hectare parcel of land with approximately 60.0 metres of frontage onto Highway 38, be provisionally approved subject to the conditions included in Exhibit B (Recommended Conditions) to Report Number COA-26-013.

That Application for Minor Variance File Numbers D10-032-2025 & D10-033-2025, for the property located at 3439 Highway 38, be amended by revising Condition 10 – Hydro Geological Assessment in Exhibit A and Condition 11 – Hydro Geological Assessment in Exhibit B to Report Number COA-26-013 in the first sentence of the third paragraph to read as follows: The applicant shall contact the environment division to confirm the requirements or approval of this condition , including additional residential well monitoring within a 500 metre radius of the severed lands, including, but not limited to, contaminants of special concern.

That the application for permission, File Number D13-001-2026, for the property located at 272 Mowat Avenue to construct an 84 square metre front addition, be Approved; and, That approval of the application be subject to the conditions attached as Exhibit A (Recommended Conditions) to Report Number COA-26-011.

That Variance Number 2 for minor variance application, File Number D13-080-2025, for the property located at 23 Soccer Lane be separated from the main recommendation and be voted on separately.

That the meeting of the Committee of Adjustment adjourn at 7:19 p.m.

Recommendation: That the application for permission, File Number D13-001-2026, for the property located at 272 Mowat Avenue to construct an 84 square metre front addition, be Approved; and, That approval of the application be subject to the conditions attached as Exhibit A (Recommended Conditions) to Report Number COA-26-011.

Recommendation: That minor variance application, File Number D13-080-2025, for the property located at 23 Soccer Lane to construct a commercial development on the vacant property, including a department store, be approved, as described below: Variance Number 1: By-Law Number 2022-62:20.1.1.L119 (d) Maximum Gross Floor Area for Department Store Requirement: 12,000 square metres Proposed: 15,000 square metres Variance Requested: 3,000 square metres; and Variance Number 2: By-Law Number 2022-62:4.16.1 Planting Strip Provisions for Non- Residential Uses Requirement: 3 metre planting strip abutting a residential use, at least 1.5 metres in height Proposed: No planting strip required where the grade change from the lot line is more than 1.5 metres Variance Requested: 3 metre planting strip. That approval of the application be subject to the conditions attached as Exhibit A (Recommended Conditions) to Report Number COA-26-015.
